Terms and Conditions

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

 

Privacy Policy

Our Privacy Policy is available on our and shall apply to You and your use of the Site and our Services.

Amendments

ND Collective reserve the right to amend these terms and conditions at any time. Any amendments shall be effective immediately upon notification on the Site. Your continued use of the Site and the Service following such notification will represent an agreement by You to be bound by the terms and conditions as amended.

Purchases

To make purchases of ND Collecitve Services, you:

  • Must be capable of forming a legally binding contract;
  • Hold a valid email address;
  • Are a body corporate registered in Australia, a partnership under the laws of a State or Territory of Australia, an Australian government authority or agency, an association (incorporated or unincorporated) under laws of a State or Territory of Australia or an individual who is at least 18 years old;
  • Are not acting in capacity as a trustee of any other person

Intellectual Property

  • Unless otherwise stated, ND Collective and/or its licensors own the intellectual property rights for all material created by ND Collective. All intellectual property rights are reserved. You understand and agree that downloading, reproducing or sharing the ND Collective program materials with any other person, would amount to a breach of intellectual property rights, and we will have the right to take action against you for breach of contract, as well as breach of statute and common law.

You must not:

  • Republish material from ND Collective
  • Sell, rent or sub-license material from ND Collective
  • Reproduce, duplicate or copy material from ND Collective
  • Redistribute content from ND Collective

Materials and Products

  • Program materials supplied to you as part of the ND Collective Therapy@Home range are subject to change.
  • ND Collective will provide you with access to a physical Therapy@Home pack. Once we have shipped the products associated with the Pack, the program will be delivered by the parent or caregiver.
  • ND Collective Therapy@Home packs should not replace the implementation of one-to-one therapy provision with an Allied Health Professional.

 

Product Delivery

  • Upon purchase, you will receive a selection of products delivered to the address that you nominate at the time of placing your order on the Site.
  • Products may differ at times in terms of brand, colour, and other cosmetic differences due to sourcing factors. This will not affect the therapeutic benefits associated with participation in any ND Collective Therapy@Home pack.
  • Costs associated with shipping come at additional costs.

Product Use and Safety Information:

  • To ensure proper use and safety of ND Collective Therapy@Home packs, it is essential to adhere to the provided instructions and Parent Guidelines.
  • Ensure that children are of the appropriate age, and their use is supervised by an adult.
  • ND Collective cannot assume responsibility for any Therapy@Home unsuitable use, including but not limited to, misuse against instructions or intended use or a lack of adult supervision.
  • ND Collective cannot tailor Therapy@Home packs to suit specific requests.

Your Obligations

You will:

  • ensure that all information provided to us is accurate; and
  • notify us of any changes to your contact particulars, including email, telephone number, and address.

No warranty or liability

  • ND Collective do not warrant or guarantee that any result or objective can, or will, be achieved or attained, as a consequence of participation Therapy@Home packs.
  • You agree and acknowledge that ND Collective or its employees, agents and/or contractors, will not be liable for any loss that you may suffer, as a result of your participation in Therapy@Home packs or use of the materials.

Privacy

All personal information that we collect about you will be handled, treated and stored in accordance with our Privacy Policy, which you agree to by agreeing to these Terms.

General

  • These Terms contain the whole agreement in respect of the subject matter of the agreement between you and us.
  • You confirm that you have not entered into these Terms on the basis of any representation that is not expressly incorporated into these Terms.
  • If any provision of these Terms is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision will, to the extent required, be severed from these Terms and rendered ineffective as far as possible without modifying the remaining provisions of these Terms, and will not in any way affect any other circumstances of or the validity or enforcement of these Terms.
  • These Terms take effect, is governed by, and will be construed in accordance with the laws from time to time in force in Queensland. You submit to the non-exclusive jurisdiction of the courts of Queensland.
